How Sphot Handles Music Licensing

The Problem with Music on Instagram

Copyright strikes are the silent killer of creator accounts. You spend hours producing a Reel, upload it, and within hours it's muted, blocked in certain countries, or removed entirely — because the background track wasn't licensed for commercial use.

Most video tools pass this problem to you. Sphot solves it at the pipeline level.

How Sphot Selects Music

When the pipeline reaches Stage 10 (Music Matching), it selects a track from a curated library of fully licensed music. The selection algorithm considers:

BPM matching — the track tempo is matched to the energy of the edit. A high-cut Montage gets a 128–140 BPM track; a Cinematic edit gets a 60–80 BPM ambient score.

Mood classification — footage sentiment is analysed and categorised (energetic, calm, inspirational, playful). The music library is tagged by mood, and the best match is selected.

Genre fit — your Brand Kit includes a content category (fitness, food, tech, lifestyle). This category influences the genre filter applied to the music selection.

Duration matching — the selected track is trimmed and faded to match the Reel duration exactly. No awkward cutoffs.

The Licensing Model

Every track in Sphot's music library is licensed under one of two frameworks:

Production music (royalty-free) — tracks produced specifically for content creators. The licence covers worldwide commercial use on social media, including Instagram, YouTube Shorts, and TikTok. No per-use fees.

Sync-licensed tracks — commercial music licensed for specific use cases. Sphot maintains sync licences for select popular tracks. These are used when the brand profile specifically requests mainstream music.

Your Sphot plan includes access to the full library. There are no per-track fees.

What About Instagram's Own Music Library?

Instagram has its own music library built into the platform, but it's only available for manually uploaded Reels through the app — not for API-published content. Sphot publishes via the Instagram Graph API, so the platform's music library isn't accessible.

This is why Sphot uses its own pre-licensed library. It's a deliberate choice that keeps your account safe.

Custom Music

If you have music you own the rights to (original compositions, commissioned tracks, purchased sync licences), you can upload it to your Brand Kit under Brand Kit → Music.

Custom tracks bypass the automatic selection and are always used when available. You can set one default track per content category.

Regional Restrictions

Some tracks are licensed for use in specific territories only. The music selection algorithm takes your account's primary publishing region into account. Indian accounts, for example, are matched to tracks with global or Asia-Pacific licences.

If you notice a track being avoided for your region, it's the system respecting territorial licensing restrictions — not a bug.

What Sphot Does Not Do

  • Sphot does not download tracks from YouTube, Spotify, or SoundCloud.
  • Sphot does not use music from Instagram's native library (API restriction).
  • Sphot does not use unlicensed commercial music.

All music in production runs goes through the licensed library or your custom uploads. No workarounds, no grey areas.
